Argentina Citizenship By Investment for backlogged US green card individuals is not currently a live option as of September 2026. What a US Immigrant Visa Backlog Is

A US immigrant visa backlog exists when more people are approved, or in line, in a category than the annual numerical limits allow. The Department of State publishes the Visa Bulletin. A category and country of chargeability are "current" when a visa number is available for that priority date. When they are not current, the applicant waits, even if USCIS has already approved the underlying petition.

Two families of cases produce the waits this page is about:

  • Employment-based immigrant categories (commonly discussed as EB-1, EB-2, and EB-3). Per-country caps mean some chargeability countries wait years after an I-140 approval. That employment-based green card backlog is the wait many H-1B holders face. The wait is a function of the bulletin, not of whether the employer or the beneficiary is ready to proceed.
  • EB-5 immigrant investor visas. These are also numerically limited. When demand from a chargeability country exceeds the supply of numbers, the bulletin can hold those cases even after a petition is approved. That EB-5 visa backlog is a visa-number wait, not a petition-merits wait.

Argentina Citizenship by Investment as a Parallel Track

Decree 524/2025 and Decree 366/2025 describe Argentine naturalization through a relevant investment, administered by APCI, without using the US visa bulletin. That is the entire relationship between the two systems: they do not share a queue.

Once the Argentine program is active, a person already in an EB-5 or employment-based wait could, in principle, pursue a qualifying Argentine investment as a separate file. That includes H-1B holders still waiting in an EB-2 or EB-3 category. The Argentine outcome, if granted, would be Argentine nationality and a passport issued on Argentina's rules. It would not be a US immigrant visa. It would not make an unavailable bulletin category current. It would not replace an I-140, an EB-5 petition, or a National Visa Center case.

"Parallel" here means simultaneous or alternative mobility, not a shortcut inside the US case. Someone who wants to keep the US petition alive can do so. Someone who wants Argentine nationality because travel, residence, or optionality cannot wait on the bulletin is asking a different question. The Argentine file, when it exists, answers the second question only.

Program status has not changed for this audience. APCI has not published operational due diligence protocols or a filing portal.
